DUI Withdrawn in Washington Township, PA

In October 2014, the Pennsylvania State Police followed a motorist for some distance before initiating a motor vehicle stop when the motorist turned into a parking lot in Washington Township, Pennsylvania. According to the complaint, the motorist was stopped because he was weaving within his own lane, traveled over the fog line, and drove on the center lines before turning into the parking lot.

Erie, PA DUI defense attorney Tim George filed a motion to suppress evidence on behalf of the motorist. In the motion, the defense argued that the MVR employed at the time of the stop revealed no violation of the Motor Vehicle Code and, therefore, there were inadequate facts to justify the stop. When the Commonwealth had an opportunity to review the suppression motion and the MVR, the DUI charges were dropped. The motorist entered a plea of guilty to a summary offense, which resulted in only a fine and courts costs. The motorist avoided prison and any suspension of his driver’s license.
