Erie Lawyers Jury Awards 850000 For Parking Lot Accident

November 5, 2010 — A jury awarded $850,000 in damages to a woman injured in a parking lot accident when struck by an Office Max truck pulling out of a parking spot. In Moyer v. Medvinsky (C.P. Phila. Cty. August 24, 2010), Kim Moyer was injured when on a break from her job as a billing clerk. She was having a cigarette in the smoking area of the parking lot with her back to the parking area when an Office Max truck backed into her.

The incident was captured on videotape although both sides believed the tape helped to support their position.

Following the truck accident, Ms. Moyer incurred $50,000 in medical expenses; was on crutches; was unable to work; had lost wages of $100,000; had future lost wages estimated at $500,000 and had future medical expenses estimated at $320,000.

The jury found the truck driver 78% at fault and Ms. Moyer 22% at fault and awarded total damages of $850,000 in damages, which award was reduced by Ms. Moyer’s percentage of fault to $663,000.
