Erie Injury Attorney News 18 Million Verdict In Chester County

April 5, 2011, ERIE, PA — A Chester County jury returned an unusually large verdict last week. In Evans v. Behrmann, the jury heard evidence about a Pennsylvania auto accident case in which the “at fault” driver went through a red light and struck the plaintiff’s van on the driver’s side. The injured driver suffered injuries to his right elbow and shoulder, including extensive ligament damage.

The injured driver was physically unable to work. He lost his job and struggled with limitations, including an inability to life more than five pounds with his right arm. The injured driver’s limitations posed a particular challenge for him because he was a parent of a child with cerebral palsy, who required particular care and attention.

The jurors awarded $1,550,000 to the injured driver and $325,000 in lost consortium damages to his wife.

The plaintiff lawyer, Gerald F. McCormick of West Chester, said the at-fault driver had always accepted responsibility for the crash and that the only question was how much his client should receive as compensation for his injuries. Still, Atty. McCormick was surprised at the size of the verdict in light of the county’s historically low verdicts. Speaking of his clients’ reaction, Mr. McCormick said, “They were flat-out overwhelmed…They were reduced to tears.”
