What Is a Tractor in Commercial Trucking?
In the commercial trucking industry, a “tractor” — sometimes called a cab, truck cab, or semi-truck — is the motorized front portion of a tractor-trailer combination. It contains the engine, cab (where the driver sits), fuel tanks, drive axles, and the fifth wheel coupling used to connect to a semi-trailer. The tractor is the power unit that pulls the trailer and is distinct from the trailer itself, which carries the cargo.
Tractors range significantly in size, power, and configuration. Day cabs are designed for short-haul runs and lack sleeping quarters. Sleeper cabs are equipped with a sleeping berth behind the driver’s seat, allowing drivers to rest during long-haul trips — a feature designed in part to help drivers comply with federal Hours of Service rest requirements.
Tractor Ownership and Liability
In Pennsylvania truck accident cases, one of the first questions attorneys must answer is who owns the tractor. Ownership structures in the trucking industry can be complex:
- Company drivers: The trucking company owns the tractor and employs the driver directly
- Owner-operators: The driver owns the tractor and operates it under a lease agreement with a carrier
- Lease arrangements: A third-party leasing company may own the tractor, which is then leased to the carrier
Each ownership structure can affect which parties may be held liable for an accident and which insurance policies apply. An owner-operator leased to a carrier, for example, may have disputes with the carrier about whose insurance covers a given accident.
Tractor Mechanical Issues and Accident Liability
The tractor’s mechanical systems — including the engine, steering, brakes, tires, and lighting — are subject to federal inspection and maintenance requirements. Failures in any of these systems can cause or contribute to accidents. If a tractor’s brakes were worn, its tires were below minimum tread depth, or its steering had a known defect, the owner and carrier may bear liability for resulting injuries regardless of driver conduct.
