Doctor Sues Hospital For Negligently Inflicted Injury, Gets $3.25 Million Verdict

A doctor injured when a hospital employee accidentally hit him in the knee while wheeling a hospital bed sued the hospital. A Lackawanna County jury returned a verdict in favor of the injured doctor for $3.25 million in October.

David Sedor, a neurosurgeon, was standing in a hallway at Community Medical Center in Wilkes-Barre when a hospital employee and a sales rep pushing a hospital bed accidentally struck him in the knee. He developed a hematoma which led to necrotizing fasciitis and the doctor's leg was amputated above the knee.

The hospital admitted that their employee struck the doctor but denied that the incident led to the necrotizing fasciitis. Instead, they said, the disease was caused by an underlying infection in the doctor's foot.

The jury obviously disagreed with the hospital's defense. The Pennsylvania injury verdict included $3 million for past and future health care expenses, past loss of income, future loss of earning capacity and an additional $250,000 for Dr. Sedor's wife's loss of consortium claim.
