A: In Pennsylvania, a second offense DUI (High Rate) means that your BAC is between 0.10% - 0.159% and you have a previous conviction for DUI within the past 10 years. This is an ungraded misdemeanor with a mandatory minimum prison sentence of 30 days and a maximum prison sentence of six months. The maximum fine is $5,000.00. Your license will be suspended for a period of at least 12 months. You would be required to complete a CRN, AHSS, D&A evaluation, and equip your vehicle(s) with an ignition interlock device for a period of 12 months.
