A: In Pennsylvania , a third offense DUI (High Rate) means that you have two previous convictions for DUI in the past 10 years and your BAC in this case is 0.10%-0.159%. This is graded as a misdemeanor of the first degree with a mandatory minimum prison sentence of at least 90 days but not more than five years. You also would be required to pay a fine of at least $1,500.00 but not more than $10,000.00. You also would receive a license suspension for a period of 18 months.
