A: In Pennsylvania, a second offense DUI (Highest Rate) means that your BAC is 0.16% or higher or you refused to submit to breath, blood or chemical testing and you have a previous conviction for DUI within the past 10 years. This is graded as a misdemeanor of the first degree with a mandatory minimum prison sentence of at least 90 days but not more than five years. You also would be required to pay a fine of at least $1,500.00 but not more than $10,000.00. Your license would be suspended for a period of 18 months. You would be required to complete a CRN, AHSS, D&A evaluation, and equip your vehicle(s) with an ignition interlock device for a period of 12 months. There may by other consequences for a conviction of this nature depending upon your driving history and the unique circumstances of your case.
