Erie Court Says PennDOT Cannot Suspend License for DUI in Kentucky

A Pennsylvania driver was convicted of Driving Under the Influence (DUI) in the State of Kentucky. As a result of the out-of-state conviction, PennDOT then suspended his Pennsylvania driver’s license for one year. Erie DUI lawyer Tim George filed an appeal to the Commonwealth Court on behalf of the driver.

After an evidentiary hearing, the Court granted our appeal and ordered that PennDOT lift the suspension because PennDOT could not prove that Kentucky was a member of the Driver License Compact. PennDOT filed an appeal to the Commonwealth Court. After briefs, the appellate court agreed that PennDOT could not suspend the man’s license. During the appeal, he was permitted to drive — and continued to drive in Pennsylvania lawfully after he won the appeal.
